                   AN ORDINANCE CLOSING AND ABANDONING PINE STREET
                   LOCATED NORTHEAST FROM NELSON ROAD, BETWEEN
                   CEDAR STREET AND AVAKIAN DRIVE, MORE
                   PARTICULARLY DESCRIBED HEREIN, UPON CERTAIN
                   CONDITIONS.

              	   SECTION 1.  BE IT ORDAINED BY THE CITY COUNCIL OF THE
         CITY OF CHATTANOOGA, TENNESSEE, That there be and is hereby 
closed
         and abandoned Pine Street located northeast from Nelson Road,
         between Cedar Street and Avakian Drive, more particularly
         described herein, and as shown on plat attached hereto and made 
a
         part hereof by reference:
                Pine Street, a 30 foot wide unopened right-of-way
                beginning on the northeast line of Nelson Road
                (unopened) 420 feet southeast of the intersection
                of the northeast line of Nelson Road with the
                southeast line of Cedar Street (unopened), and
                extending northeast 315 feet between parallel
                lines, and parallel to Cedar Street.  Said street
                separates lots 17, 20, and 23, from lots 18, 21,
                and 24, Nelson's Subdivision, not recorded.  Tax
                Map No. 159G-E-6 and 12.3.
               
               
              	   SECTION 2.  BE IT FURTHER ORDAINED, That this closure
         and abandonment is made subject to the following conditions:

                1. The City of Chattanooga has a sewer located
                   within the right-of-way and reserves an easement
                   for the purpose of maintaining said sewer.
               
                2. The recommendation by the Planning Commission
                   for the construction of a cul-de-sac on the
                   north end of this closure is not applicable
                   since the closure of Pine Street from the north
                   end of this closure to Igou Gap is in the
                   process of review.  In the event that the
                   closure now being reviewed is not approved, then
                   a cul-de-sac will be required for this closure
                   (case No. 1992-238).
               
                3. The areas reserved for utility easements must be
                   kept free and clear of all structures.
               
                4. All existing easements are retained.
               
              	   SECTION 3.  BE IT FURTHER ORDAINED, That this 
Ordinance
         shall take effect two weeks from and after its passage as 
provided
         by law.
